Bod by Bree Terms of Use
Last updated: October 2026
These Terms of Use (this "Agreement") govern your use of the Bod by Bree website at bodbybree.com, the Bod by Bree mobile and web apps (including app.bodbybree.com), and the workouts, programs, memberships, personal training and coaching, general nutrition guidance and other content and services we provide (together, the "Service"). The Service is operated by Bod by Bree LLC ("Bod by Bree," "we," "us" or "our"). By using the Service or buying a membership or program, you agree to this Agreement and to our Privacy Policy at bodbybree.com/privacy. This Agreement applies to everyone who accesses or uses the Service, including visitors, free users and paying members, whether or not you have an account. Please read it carefully.
THIS AGREEMENT CONTAINS A MANDATORY ARBITRATION PROVISION (SECTION 15) THAT REQUIRES DISPUTES TO BE RESOLVED BY INDIVIDUAL ARBITRATION RATHER THAN JURY TRIALS OR CLASS ACTIONS.
1. Changes to these terms
We may update this Agreement from time to time. When we make a material change, we will update the date above and, for active members, notify you by email or in the app before the change takes effect. If you continue to use the Service after the change, you accept the updated Agreement. If you do not agree, stop using the Service and cancel your membership. We encourage you to review this page from time to time.
2. Using the Service
a. Eligibility. You must be at least 13 years old, or the minimum age in your country for using online services without a parent's consent (up to 16 in some European countries), whichever is higher. To buy a membership, program or training, you must be at least 18 or the age of majority where you live, or have a parent or guardian's permission. You may use the Service only if you can form a binding contract, and only in compliance with this Agreement and all applicable local, state, national and international laws. The Service is not available to anyone we have previously removed from it.
b. Your account. You can browse parts of the Service without creating an account. If you create one, you are responsible for activity on your account and for keeping your login details private. We are not liable for losses caused by unauthorized use of your account. You agree to give true, accurate and current information when you register or buy, and to keep it up to date. If information you give is false, or we reasonably suspect it is, we may suspend or end your account. If you sign in with a third-party service such as Facebook, you allow us to access and use the information that service shares with us, as permitted by that service, and to store your login credentials for it, as described in our Privacy Policy.
c. Community features. The Service may include community chat walls, groups and messaging. You are responsible for your interactions with other members. We may, but are not required to, monitor or step into disputes between members. We are not responsible for your interactions with other members or for any member's actions.
d. App store terms. If you use our app from the Apple App Store or Google Play, you also agree to that store's terms of use, privacy policy and acceptable use policies, and Apple and Google decide independently whether our app meets their standards. If you downloaded the app from the Apple App Store: this Agreement is between you and Bod by Bree, not Apple; Apple has no obligation to provide maintenance or support for the app; to the extent allowed by law, Apple has no warranty obligation for the app beyond refunding the purchase price if the app fails to meet any applicable warranty; Apple is not responsible for any claims relating to the app, including product liability, legal or regulatory claims, consumer protection claims or intellectual property claims; and Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce it against you.
e. Changes to the Service. We regularly add, change and retire workouts, programs and features. We may also add or remove features for some or all users and set reasonable usage limits. We may make these changes without prior notice, except that price changes for your plan follow section 3b.
f. Acceptable use. You agree not to: harass, threaten or abuse anyone; post unlawful, hateful, sexually explicit or infringing content; share, record, download or redistribute paid content; share your account or login; use bots, scrapers or other automated tools; copy, reverse engineer or interfere with the Service; or use the Service for advertising or solicitation we have not approved. We may remove content or suspend accounts that break these rules.
g. Platforms we use. The Bod by Bree app is hosted by our app platform provider, BuildFire, which manages app logins and accounts. Purchases made inside the app are processed and managed by Apple (App Store) or Google (Google Play). Purchases made on our website are processed by Stripe. For login or account help, contact us at bree@bodbybree.com and we will help or point you to the right support team. These providers have their own terms and privacy policies, and we are not responsible for their services.
3. Memberships and billing
a. Plans. We offer Monthly, Semi-Annual and Annual memberships. The current price and billing period for each plan are shown at checkout before you buy. Prices are in U.S. dollars unless shown otherwise. Applicable taxes, such as sales tax, VAT or GST, may be added. If you pay in another currency, your bank or card issuer may apply its own exchange rate or foreign transaction fees, which are your responsibility.
b. Automatic renewal. Your membership renews automatically at the end of each billing period (every month, every 6 months or every year, depending on your plan). The renewal is charged to the payment method on file at the then-current price, until you cancel. If we change the price of your plan, we will tell you by email before the new price applies to you, and you can cancel before it takes effect. By subscribing, you authorize us (or Apple or Google, if you subscribed in the app) to charge your payment method automatically on the same date each billing period, for the amount shown at checkout plus any applicable taxes, until you cancel. You are responsible for keeping your payment information current; we are not responsible for failed or incorrect charges caused by expired or inaccurate payment details.
c. Free trials. If your plan includes a free trial, the trial starts the day you sign up and lasts for the number of days shown at checkout. You must enter a payment method to start a trial. You get full access during the trial and can cancel at any time before it ends, at no charge, using the steps in section 3d. If you do not cancel before the trial ends, the plan price is charged automatically when the trial ends, and that date becomes your billing date. Free trials are limited to one per person; if you have had a free trial before, you may be charged when you sign up.
d. How to cancel. You can cancel at any time, online, with no need to contact us:
If you subscribed on our website (bodbybree.com):
• Go to our Manage Membership page at billing.stripe.com/p/login/aEU182dbje86cjCcMM, enter the email you used to pay, and select Cancel; or
• Email bree@bodbybree.com and we will cancel for you.
If you subscribed in the app through the Apple App Store (iPhone or iPad):
Step 1. Open the Settings app and tap your name.
Step 2. Tap Subscriptions.
Step 3. Select Bod by Bree and tap Cancel Subscription.
If you subscribed in the app through Google Play (Android):
Step 1. Open the Google Play Store app and tap your profile picture.
Step 2. Tap Payments & subscriptions, then Subscriptions.
Step 3. Select Bod by Bree and tap Cancel subscription.
App Store and Google Play subscriptions are billed and managed by Apple or Google, so we cannot cancel or refund them for you. Deleting the app or logging out does not cancel a subscription. The steps in Apple's and Google's menus may change over time; their help pages have the latest instructions.
Your cancellation takes effect at the end of your current billing period. You keep full access until then, and you will not be charged again.
e. Refunds. Membership fees are non-refundable once charged, including for unused time in a billing period. If you were charged twice or charged by mistake, contact us and we will refund the incorrect charge. Any other refund is at our sole discretion.
f. Failed payments. If a renewal payment fails, we will email you a secure link to update your card and will retry the charge for up to about 3 weeks. If payment still cannot be collected, your membership will be canceled and your access will end.
g. App Store and Google Play purchases. If you subscribed through Apple or Google, your subscription is billed and managed by them. Cancel in your device's subscription settings. Refund requests for those purchases go to Apple or Google under their policies.
h. Programs. One-time programs and challenges (such as Sets + Reps) are single purchases, not subscriptions, and do not renew. Program purchases are non-refundable once purchased.
i. Personal training and coaching. Personal training sessions, packages and coaching (virtual or in person) are scheduled and paid as described when you book. Sessions canceled or rescheduled with less than 24 hours' notice, and missed sessions, count as used. Unused sessions expire 12 months after purchase. Training and coaching purchases are non-refundable once purchased, except as stated in section 3e.
j. Promotions and discount codes. Discount codes and promotions are subject to their stated terms, have no cash value, cannot be combined unless stated, and may end at any time. A discount applies only to the charges stated in the offer.
k. Members outside the United States. If you live in the European Union, the United Kingdom or another country that gives consumers a right to cancel digital services within a set period (often 14 days), by agreeing to these terms at checkout or when you start your subscription, you expressly ask us to give you access immediately, and you acknowledge that you lose that cancellation right once access begins, to the extent your local law allows. Nothing in this Agreement removes rights you have under the mandatory consumer protection laws of your country.
l. Delivery. After you buy, you can access digital memberships, programs and content through the app or your account, and we send a confirmation email to the address you gave at checkout. Digital purchases are delivered when access is made available to you.
m. Chargebacks. If you have a problem with a charge, please contact us first at bree@bodbybree.com so we can fix it. If you file a chargeback or payment dispute, we may suspend your access to the Service while it is reviewed and share this Agreement and records of your purchase and use with the payment processor. If the dispute is decided in our favor, or you used the Service during the period charged, you remain responsible for the amount owed. This does not affect any rights you have under the law.
n. Live and in-person events. We may offer live virtual or in-person events, workshops, retreats or meetups. Event tickets are non-refundable once purchased, except that if we cancel an event, we will refund the ticket price; we are not responsible for travel, lodging or other costs. With our approval, you may transfer your ticket to another person. You may be asked to sign a separate waiver before taking part. You are responsible for your own health, safety, belongings and travel, and section 6 applies to all event activities. Events may be photographed or filmed, and by attending you allow us to use photos and video that include you to promote Bod by Bree; if you prefer not to appear, tell our team at the event. We may refuse entry to, or remove without refund, anyone whose behavior is unsafe or disruptive.
o. Merchandise. Orders are subject to availability and our acceptance. Prices, shipping costs and delivery estimates are shown at checkout. Orders shipped outside the United States may be subject to customs duties, import taxes and fees, which are the buyer's responsibility. To the extent the law allows, risk of loss passes to you when your order is handed to the carrier. Returns and exchanges follow the policy shown on the product page at the time of purchase. If no policy is shown, items that arrive damaged, defective or incorrect will be replaced or refunded if you contact us within 14 days of delivery, and all other merchandise sales are final.
4. Your content
a. What you post. You may be able to post comments, photos, messages and other material ("User Content"). You keep ownership of your User Content.
b. Permission to use it. By posting User Content, you give us a non-exclusive, royalty-free license to host, display and share it within the Service so the Service works as intended (for example, showing your post on a community wall). We will not use your name, photos or posts in our marketing or advertising outside the Service unless you give us permission. We will ask you first, for example by message or email, and use your post only if you say yes. If you tag Bod by Bree's social media accounts or use one of our hashtags in a public post, you give us permission to reshare that post on our own channels with credit to you. You can ask us to remove any reshare at any time.
c. Your responsibility. You confirm that you have the rights to what you post and that it does not violate anyone else's rights. We may, but are not required to, reject or remove any User Content we believe violates this Agreement. You are responsible for the User Content you post. We are not responsible for how other users or third parties display, share or misuse User Content you choose to post in community areas. We take no responsibility for User Content posted by others, and we act only as a passive conduit for the User Content you choose to share. Any loss or damage that results from User Content you post or access is your responsibility.
5. Our content
a. Ownership. Except for User Content, everything in the Service, including workouts, videos, programs, text, graphics, logos, designs, page headers, button icons, scripts, service names and the Bod by Bree name, belongs to us or our licensors and is protected by Intellectual Property Rights in the United States and other countries. "Intellectual Property Rights" means patents, copyrights, moral rights, trademarks, trade dress, rights of publicity, goodwill, trade secrets and similar rights anywhere in the world, including registrations, renewals and extensions. You may not use our name, logo or trademarks, including in a domain name or social media handle, in any way that is likely to cause confusion or suggest that we endorse you.
b. Personal use only. Your membership gives you a personal, non-transferable right to use the Service for your own fitness. Except as this Agreement expressly allows, nothing in it gives you a license to our content. You may not sell, license, rent, modify, distribute, copy, reproduce, transmit, record, publicly display or perform, publish, adapt, edit or create derivative works from our content, or share your login with others. Any use of our content not expressly permitted by this Agreement is prohibited.
c. Feedback. If you send us ideas or feedback, we may use and share them freely, without paying you and on a non-confidential basis. Feedback is voluntary and creates no obligation for us. Using your feedback does not limit our right to use similar ideas we already had or received from others.
d. Usage data. We collect information about how the Service is used, as described in our Privacy Policy.
6. Health, fitness and nutrition disclaimer
Bod by Bree strongly recommends that you consult with your physician before beginning any exercise program or making any dietary changes or undertaking any other activities described in programs, workouts, the website at bodbybree.com, or in the Bod by Bree online and mobile applications, podcasts, social media and videos owned and operated by Bod by Bree ("Bod by Bree Content"). You need to be in good physical condition to be able to participate in the exercises described in the Bod by Bree Content, including all workouts and programs. Specifically, by accepting these terms and proceeding with Bod by Bree Content you affirm that you are in good physical condition and do not suffer from any known disability or condition which would prevent or limit your participation in vigorous physical activity, including but not limited to resistance training, body weight calisthenics, cardiovascular training, jumping, running and stretching.
You fully understand that you may injure yourself as a result of your participation in any program that Bod by Bree may recommend, and you, on behalf of yourself and your heirs, next of kin, family, estate and representatives, release Bod by Bree and its owners, officers, employees, contractors, trainers, agents, partners, affiliates, successors and assigns (the "Released Parties") from any and all claims or causes of action, known or unknown, now or in the future, related to participating in activities or information described in or arising out of Bod by Bree Content. These conditions may include, but are not limited to, heart attacks, muscle strains, muscle pulls, muscle tears, broken bones, shin splints, heat prostration, injuries to knees, back or feet, or any other illness or soreness, including death. You assume these and all other risks of participating, known or unknown, including risks of physical, mental or emotional injury or illness, whether caused by your own actions or by the acts, omissions, recommendations or advice of the Released Parties, and you agree not to bring any legal action against the Released Parties for them, to the fullest extent permitted by law.
Bod by Bree is not a licensed medical care provider and has no expertise in diagnosing, examining or treating medical conditions of any kind, or in determining the effect of any specific exercise on a medical condition. Bod by Bree Content is not a substitute for professional medical advice, diagnosis or treatment. After attending classes, participating in programs, watching videos, listening to podcasts or vlogs, or accessing other Bod by Bree Content, you are encouraged to review the information carefully with your healthcare provider. Never disregard professional medical advice or delay seeking it because of something in Bod by Bree Content, and never rely on Bod by Bree Content in place of professional medical advice. If you think you are having a medical emergency, stop exercising and call your local emergency number immediately. By proceeding and participating, you agree to these terms.
Personal training. Personal training and coaching, whether virtual or in person, involve physical activity and the same risks described above. Before and during training, tell your trainer about any injury, health condition, pregnancy, medication or symptom that could affect your safety, and stop and seek help if you feel pain, dizziness or shortness of breath. For virtual sessions, you are responsible for training in a safe space with suitable equipment. You participate voluntarily and assume these risks.
Nutrition guidance. Any nutrition information, meal ideas, recipes, macro or calorie suggestions, or other nutrition guidance from Bod by Bree is general wellness information for healthy adults. It is not medical nutrition therapy, and Bod by Bree is not a registered dietitian or medical provider. It is not intended to diagnose, treat, cure or prevent any disease or condition. Talk to your doctor or a registered dietitian before changing your diet, especially if you are pregnant or breastfeeding, have a medical condition, food allergy or intolerance, take medication, or have a history of disordered eating. You are responsible for checking ingredients for allergens.
Results. Results from workouts, training and nutrition vary from person to person and depend on many factors. We do not guarantee any particular result, and any testimonials or transformations shown are individual experiences, not typical or promised outcomes.
7. Messages
You may be able to send messages to other members or to us through the Service. We may send you service and administrative messages, such as login details, billing notices and changes to these terms. If you give us your mobile number and opt in, we may also send you text messages; message and data rates may apply, and you can reply STOP to opt out at any time. When you create an account or buy from us, we add your email address to our mailing list so we can send account information and news about our workouts, programs, events and offers. You can unsubscribe from marketing emails at any time; we will still send account, billing and service messages.
8. Copyright
We require users to respect the copyright and other intellectual property rights of others. If you believe something in the Service infringes your copyright, email bree@bodbybree.com with: your contact details; a description of the copyrighted work; where the material appears in the Service; a statement that you believe in good faith the use is not authorized; a statement that your notice is accurate and that you are the owner or authorized to act for the owner; and your physical or electronic signature. We will remove infringing material and may end the accounts of repeat infringers.
9. Privacy
Our Privacy Policy at bodbybree.com/privacy explains what information we collect and how we use it. By using the Service, you consent to the collection, use, disclosure and international transfer of your information as described there. You provide your information at your own risk. No security system is perfect, and we cannot guarantee that unauthorized third parties will never defeat our security measures.
10. Indemnity
You agree to defend, indemnify and hold us and our owners, officers, affiliates, agents, contractors, vendors and employees harmless from any claims, damages, obligations, losses, liabilities, costs, debts and expenses (including reasonable attorneys' fees) arising from: (i) your use of the Service; (ii) your violation of this Agreement; (iii) your violation of any third-party right, including privacy or intellectual property rights; (iv) your violation of any law, rule or regulation; or (v) any User Content you post or anything submitted through your account.
11. No warranty
THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," AND YOUR USE IS AT YOUR OWN RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE CONTENT ON THE SERVICE IS ACCURATE, RELIABLE OR CORRECT; THAT THE SERVICE WILL BE AVAILABLE AT ANY PARTICULAR TIME OR LOCATION, UNINTERRUPTED, ERROR-FREE, SECURE OR FREE OF VIRUSES; THAT ANY DEFECTS OR ERRORS WILL BE CORRECTED; OR THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR PRODUCE ANY PARTICULAR FITNESS RESULT.
ANY CONTENT YOU DOWNLOAD OR OTHERWISE OBTAIN THROUGH THE SERVICE IS AT YOUR OWN RISK, AND YOU ARE RESPONSIBLE FOR ANY DAMAGE TO YOUR DEVICE OR LOSS OF DATA THAT RESULTS. WE DO NOT WARRANT, ENDORSE OR TAKE RESPONSIBILITY FOR ANY PRODUCT OR SERVICE ADVERTISED OR OFFERED BY A THIRD PARTY THROUGH THE SERVICE OR ANY LINKED WEBSITE, AND WE ARE NOT A PARTY TO ANY TRANSACTION BETWEEN YOU AND A THIRD-PARTY PROVIDER.
12. Third-party links and services
The Service may link to or rely on websites and services we do not own or control, including payment processors and app stores. We are not responsible for their availability, content, products, policies or practices, or for any loss caused by your use of or reliance on them. This Agreement and our Privacy Policy do not apply to your use of those sites and services. Please read their terms and privacy policies.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS AND LICENSORS WILL NOT BE LIABLE, UNDER CONTRACT, TORT, STRICT LIABILITY, NEGLIGENCE OR ANY OTHER LEGAL THEORY, FOR ANY LOST PROFITS, SUBSTITUTE GOODS OR SERVICES, OR ANY INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES ARISING FROM THE SERVICE OR ANY CONTENT ON IT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.
UNDER NO CIRCUMSTANCES WILL WE BE RESPONSIBLE FOR ANY DAMAGE, LOSS OR INJURY RESULTING FROM HACKING, TAMPERING OR OTHER UNAUTHORIZED ACCESS TO OR USE OF THE SERVICE, YOUR ACCOUNT OR THE INFORMATION IN IT.
IF YOU ARE DISSATISFIED WITH THE SERVICE OR WITH THIS AGREEMENT, YOUR SOLE AND EXCLUSIVE REMEDY IS TO STOP USING THE SERVICE AND CANCEL YOUR MEMBERSHIP.
The Service is operated from the United States and is available to members around the world. We do not promise that the Service or any content is appropriate, legal or available in every country. If you use the Service from outside the United States, you do so on your own initiative and are responsible for following your local laws, including import and export rules. You may not use the Service if you are located in a country subject to U.S. sanctions or embargoes, or if you are on a U.S. or other applicable government restricted-party list. Some countries do not allow certain limits on warranties or liability; in those countries, our limits apply to the fullest extent your local law permits.
14. Ending your account
We may change, suspend or discontinue all or part of the Service at any time. We may also suspend or end your access at any time, with or without notice, including if you violate this Agreement, for example by sharing your login or posting abusive content. If we end a paid membership without cause, we will not be liable to you except that we will refund the unused part of any prepaid fees. If we end it because you violated this Agreement, no refund is due. When your account ends, your right to use the Service ends immediately. Sections that by their nature should survive termination, including ownership, disclaimers, indemnity, limitation of liability and arbitration, will survive.
15. Governing law and arbitration
a. Governing law. You agree that the Service is based solely in California. This Agreement is governed by the laws of the State of California, without regard to its conflict-of-law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply. If you live outside the United States, you also keep the benefit of any mandatory consumer protection laws of your country that cannot be changed by agreement. For any matter not subject to arbitration, you agree to the courts located in San Diego County, California.
b. Informal resolution first. Before starting any formal dispute, contact us at bree@bodbybree.com and give us 30 days to try to resolve it.
c. Arbitration. If we cannot resolve it informally, any claim arising from this Agreement or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, in the county where you live, or, if you live outside the United States, by video conference or in San Diego County, California, in English, unless your local mandatory law requires otherwise. Either party may bring an eligible claim in small claims court instead. Either party may seek a court order to stop actual or threatened infringement or misuse of its intellectual property rights or data security. Arbitration fees will be paid as set out in the AAA Consumer Arbitration Rules, which assign most fees to us. Each party pays its own attorneys' fees unless the arbitrator awards them under applicable law.
d. No class actions. ALL CLAIMS MUST BE BROUGHT INDIVIDUALLY, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE PROCEEDING. UNLESS WE BOTH AGREE OTHERWISE, THE ARBITRATOR MAY NOT COMBINE MORE THAN ONE PERSON'S CLAIMS. YOU AND WE EACH WAIVE THE RIGHT TO A JURY TRIAL.
16. General terms
a. Relationship. This Agreement does not create any partnership, agency or employment relationship.
b. Notices. We may send notices by email, in-app or push notification, or by posting on the Service. We are not responsible if your email settings or email provider filter or block our notices. We decide the form and method of notices, and you can opt out of some methods, such as marketing emails.
c. Entire agreement and severability. This Agreement, our Privacy Policy and any additional terms you agree to when you buy a specific product or service are the entire agreement between you and us about the Service. If any part is found unenforceable, that part will be replaced by a valid provision that comes closest to its intent, or limited or removed only as much as necessary, and the rest stays in effect. Our failure to enforce any part is not a waiver.
d. Assignment. You may not transfer this Agreement without our written consent. We may transfer, assign or delegate this Agreement and our rights and obligations without your consent, for example if the business is sold.
e. Events beyond our control. We are not responsible for delays or failures caused by events beyond our reasonable control, such as natural disasters, illness, internet or platform outages, or actions of governments or third-party providers.
f. Electronic communications. You agree to receive agreements, notices and other communications from us electronically, and that they satisfy any legal requirement that communications be in writing. A printed copy of this Agreement or of any electronic notice may be used in legal proceedings like any other business record.
g. Language. This Agreement is written in English. If it is translated, the English version controls to the extent the law allows.
